MEMBER TERMS AND CONDITIONS

1. Nature of Membership

Membership is a privilege granted by the Organization and does not constitute:

• Ownership interest
• Equity stake
• Employment
• Partnership
• Agency

Membership is revocable at the discretion of the Organization.

2. Account Registration and Electronic Consent

By registering an account, you:

• Consent to electronic communications
• Acknowledge validity of electronic records under RA 8792
• Confirm that information submitted is accurate
• Submission of false information may result in termination.

3. Account Security

• Members are solely responsible for safeguarding login credentials.
• All actions performed using a member’s credentials are presumed authorized by the account holder unless proven otherwise.
• Negligence in protecting credentials shall not create liability on the part of the Organization.

4. Capability-Based Access

Access to pages and features is governed strictly by assigned capabilities.

Members shall not:

• Attempt to override system controls
• Access unauthorized pages
• Manipulate capability assignments

Unauthorized attempts may result in immediate suspension and possible legal action under applicable Philippine laws.

5. Administrative Authority

The Organization retains full authority to:

• Assign or revoke capabilities
• Modify member privileges
• Suspend or terminate accounts
• Restrict or restructure system access

Administrative decisions are final and executory.

No member shall claim vested rights to any capability or system access.

6. Acceptable Use

Members agree not to:

• Use the system for unlawful purposes
• Interfere with system integrity
• Introduce malicious code
• Attempt privilege escalation
• Misrepresent identity

Violations may result in civil or criminal liability.

7. Data Privacy Compliance

Personal information collected during registration is processed in accordance with:

• Republic Act No. 10173 (Data Privacy Act of 2012)

Members acknowledge that:

• Data is collected for legitimate organizational purposes
• Access controls are implemented
• Absolute security cannot be guaranteed
• A separate Privacy Policy governs data processing.

8. Termination

Membership may be suspended or terminated:

• With or without cause
• With or without prior notice

Upon termination:

• Access rights cease immediately
• Assigned capabilities are revoked
• The Organization may retain records as required by law

Termination does not extinguish liability arising prior to termination.

9. Limitation of Liability

To the maximum extent allowed under Philippine law, the Organization shall not be liable for:

• Loss of data
• Service interruptions
• Unauthorized access
• Incidental or consequential damages

10. Indemnification

Members agree to indemnify and hold harmless the Organization from any claims, damages, or liabilities arising from:

• Misuse of the website
• Violation of these Terms
• Breach of applicable laws

11. Amendments

These Terms may be amended at any time. Continued use constitutes acceptance of the revised Terms.

12. Governing Law and Venue

These Terms are governed by Philippine law. Any dispute shall be brought exclusively before the proper courts of Bacolod City, Philippines.
